Affiliate Terms & Conditions

These Affiliate Terms & Conditions (“Agreement”) govern your participation in the Yes Golf Affiliate Program (“Program”). This Agreement is between YES DREAM GOLF INC., a California corporation (“Yes Golf,” “Company,” “we,” “us,” or “our”), and you (“Affiliate,” “you,” or “your”).

By applying to or participating in the Program, you agree to these terms.

1. Eligibility & Enrollment

To participate, you must be 18 years of age or older.

All affiliate applications are manually reviewed. We aim to build a community of partners who align with the Yes Golf brand, so approval is at our discretion. We reserve the right to accept or decline any application.

The following types of affiliates are not eligible:

  • Coupon or deal aggregation sites
  • Incentivized traffic platforms
  • Adult or explicit content websites
  • Any platform that may negatively impact the Yes Golf brand

2. Affiliate Relationship

This Agreement does not create a partnership, joint venture, employment, or agency relationship. Affiliates act independently and may not represent themselves as speaking or acting on behalf of Yes Golf.

3. Commissions

3.1 How Commissions Are Earned
Affiliates earn commissions based on a percentage of qualifying sales generated through approved affiliate links.

3.2 Qualifying Sales
A sale qualifies when:

  • A customer completes a purchase
  • The transaction is successfully tracked
  • The order is not returned, refunded, or charged back

3.3 Non-Qualifying Transactions
Commissions are not paid on:

  • Returned or refunded orders
  • Chargebacks or fraudulent transactions
  • Self-referrals or purchases made by the Affiliate

If a commission is paid in error, we may deduct or reverse it in a future payout.

4. Payments

4.1 Payment Schedule
Approved commissions are paid monthly, following internal verification.

4.2 Minimum Payout
Affiliates must reach a minimum balance of $100 USD to receive payment.

4.3 Payment Methods
Payments are made via ACH or Zelle, in USD.

4.4 Taxes
Affiliates are responsible for reporting and paying any applicable taxes related to commissions earned.

5. Marketing Guidelines

We want affiliates to be creative and authentic while keeping brand trust intact.

5.1 Paid Advertising
Affiliates may run paid ads promoting their own content or messaging. However, bidding on Yes Golf brand terms (including “Yes Golf,” “Yes Golf Shop,” or “yesgolfshop.com”) in paid search advertising is not permitted.

5.2 Brand Name Usage
Affiliates may use the Yes Golf name in domains, social media handles, and promotional content as long as the use is accurate, transparent, and not misleading.

5.3 Email Marketing
Email marketing is allowed provided recipients have opted in and emails comply with applicable laws (including CAN-SPAM).

5.4 Coupons & Incentives
Use of coupons and incentives is permitted unless otherwise communicated by Yes Golf.

6. Intellectual Property

Yes Golf may provide approved marketing assets such as logos, banners, or copy. Affiliates may also create their own content using Yes Golf brand assets, provided the content is respectful and accurate and brand assets are not altered in a misleading way.

All intellectual property remains the property of Yes Golf.

7. Termination

Either party may terminate participation in the Program at any time, with or without cause.

Upon termination:

  • Affiliate links must be discontinued
  • Unpaid commissions may be forfeited
  • Yes Golf brand assets must no longer be used

8. Limitation of Liability

Yes Golf is not liable for indirect, incidental, or consequential damages related to the Program. Our total liability will not exceed the commissions paid to you under this Agreement.

9. Governing Law

This Agreement is governed by the laws of the State of California, USA, without regard to conflict-of-law principles.

10. Modifications

We may update these Terms & Conditions from time to time. Continued participation in the Program after changes are posted constitutes acceptance of the revised terms.
